Wydawać by się mogło, że osoby zajmujące się marketingiem w większości działających w naszym kraju poważnych firm, przyswoiły sobie już wiedzę z zakresu konieczności rejestracji domen internetowych nawiązujących do ich znaków towarowych. Nie wszystkie… Firma Ferrero Polska rozpoczęła bój o zablokowanie strony maxiking.pl, która jest serwisem sopockiej spółki wytwarzającej marcepanowe penisy w czekoladzie.
W czym problem? Nazwa i adres www firmy Max i King sp. z o. o. budzą bliskie skojarzenie z nazwą batonika Ferrero – Kinder Maxi King. Pikanterii całej sprawie – oprócz niewątpliwej pikanterii wynikającej z majaczących w tle czekoladowych penisów – dodaje fakt, że Ferrero Polska prowadzi właśnie kampanię „Welcome to Miami”, której jednym z elementów jest loteria z wycieczką do Miami jako główną nagrodą. I w tym miejscu pojawiają się schody… Konkursowa strona została uruchomiona pod adresem kindermaxiking.pl, natomiast spoty reklamowe – w wyniku „małego” niedopatrzenia – zapraszają do odwiedzin maxiking.pl, czyli strony sopockiego producenta marcepanowego przyrodzenia…
Tym co przede wszystkim rzuca się w oczy w tej sprawie to fakt, że domena maxiking.pl została zarejestrowana dopiero w październiku 2007 roku, natomiast domena kindermaxiking.pl, własność Ferrero Polska, dwa lata wcześniej – w kwietniu 2005 roku. Sytuacja ta pokazuje, że obecny stan rzeczy jest w dużej mierze niedopatrzeniem firmy Ferrero, która przez ponad 2 lata nie zadbała o zabezpieczenie nazwy domeny kojarzącej się z jej produktem.
Jak jednak stwierdził przedstawiciel Ferrero Polska, nazwy wszystkich produktów tej firmy są zarejestrowanymi znakami towarowymi, w związku z czym doszło do naruszenia prawa do znaku batonika Kinder Maxi King. Problem w tym, że Max i King sp. z o. o. również jest właścicielem znaku towarowego – tyle, że „MAX i KING”. Fakt ten potwierdza więc prawo firmy z Sopotu do korzystania z domeny maxiking.pl. Oczywiście kompetentnym organem do definitywnego rozstrzygnięcia tej kwestii jest sąd arbitrażowy, który zajmuje się sporami dotyczącymi domen internetowych, jednakże zdrowy rozsądek przemawia na korzyść sopockiej firmy.
Mimo, że fakty przemawiają za Max i King, ciężko przewidzieć jak w tej konkretnej sprawie zachowałby się sąd. Jednym z przykładów tego typu sytuacji jest niedawny spór wokół domeny gmail.pl. Została ona zarejestrowana dopiero w 2006 roku, a więc w momencie kiedy na rynku działała już popularna poczta Google’a. Właściciel utworzył pod nią stronę „Grupa Młodych Artystów i Literatów” – w skrócie GMAIL. Google żądało bezpłatnego zwrócenia domeny. W efekcie wszczęto postępowanie, które jednak zostało umorzone. Innym przykładem tego typu sprawy jest spór o domenę lh.com, która teoretycznie może być rozwinięciem wielu skrótów, ale sąd nakazał oddać ją linii lotniczej Lufthansa.
W sprawie sporu Ferrero z Max i King sp. z o. o. wątpliwości może budzić jedynie fakt uruchomienia subdomeny kinder.maxiking.pl (obecnie nie ma pod nią żadnej treści), która może niebezpiecznie zbliżyć producenta czekoladowych penisów do naruszenia znaku towarowego Kinder Maxiking. Ta kwestia budzi już pewne obiekcje.
Podsumowując, należy jednak stwierdzić, że cała sytuacja jest wynikiem niedopatrzenia osób odpowiedzialnych za marketing Ferrero Polska, które nie zarejestrowały w odpowiednim czasie spornej domeny, a następnie dopuściły do emisji błędnej informacji w reklamie. Przerzucanie odpowiedzialności na sopocką firmę Max i King, która – według Ferrero – naruszyła prawa do znaku towarowego, jest po prostu próbą tuszowania własnych błędów.
